Arbitration Fees
The arbitration fees generally include four items:
- AEADE fees
- Arbitrator’s fees
- Notary’s fees (optional)
- Notification expenses
- Representative or counsel fees and expenses (optional)
As a general rule, without prejudice to the arbitrator’s free judgement, the arbitration fees are borne by the party who fails to comply with the contract.
Expenses and costs
AEADE does not charge a provision for funds to any of the parties. However, the claimant must advance a fixed sum to cover the above-mentioned arbitration costs. AEADE refers to this amount as Expenses and Costs.
These amounts will always be paid by the party found at fault. In all cases, the expenses and costs paid in advance by the claimant will be reimbursed once the proceedings have concluded, provided they are declared successful in their claim, and the amounts are obtained from the party at fault.
